BOOKSY X PRESELY POE & FRIENDS RAFFLE TERMS AND CONDITIONS

“Entrant”, you” and “your” mean a Giveaway entrant who meets the conditions of participation set forth in point 5;
“authorized account holder” is defined as the natural person to whom the email address is assigned by an Internet service provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address;
“Event” means the Presely Poe & Friends event which takes place on April 13th-April 14th;
“Giveaway” means the lottery based on the game of chance where the three (3) Entrants will be randomly selected as winners of prizes set forth in point 14;
“Sponsor”, “we”, “our”, and “us” mean Booksy, Inc., an Illinois corporation with a principal place of business located at 515 North State Street, Suite 460, Chicago, IL 60654.

2. The following Official Giveaway Rules and Appendices hereto, together with the Terms and Conditions, Privacy Policy and relevant information set out on the promotional pages for said Giveaway are subject to the terms and conditions set forth below.

3. By participating in the Giveaway, the Entrant agrees that has read, fully understood, and accepted the presented terms and conditions. Lack of acceptance of all or part of the same will imply the exclusion of the Entrant.

4. We may modify, add to, suspend or delete these Official Giveaway Rules, in whole or in part, at our sole discretion at any time, with such modifications, additions or deletions being immediately effective upon their posting to the pages. Your continued participation in the Giveaway after modification, addition or deletion of the Official Giveaway Rules shall be deemed to constitute acceptance by you of the modification, addition or deletion.

5. Entrants must be legal U.S. residents, at least eighteen (18) years old, who are attendees on the Event. Employees of the Sponsor, our affiliates, vendors, and partners, promotional agencies and their advertising agencies, employees of other event hosting services, and members of the immediate families of such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents and grandchildren, and any other person residing in the same household whether or not related. Winning a giveaway prize is contingent upon fulfilling all requirements set forth herein.

6. To take part in the Giveaway the Entrant shall fill out the form with personal details located on the landing page of the Event cf.booksy.com/win-a-surprise-booksy-pro-box. Raffle submission will only be open during the Event, i.e. April 13th-April 14th.

7. The Entrants are obliged to provide the Sponsor with their contact information such as name, business name, telephone number, and postal address.

8. All Entrants must provide valid contact details upon entry. It shall be the Entrant’s responsibility to update the Sponsor of any change in their contact details.

9. Limit one (1) submission per person during the Event. Additional entries may be made by referring friends and family to Giveaway who also participate in the Event.

10. Entries using macro, robotic, script, or other forms of automatic entry will be disqualified.

11. If there is a dispute as to the identity of an online Entrant, the prize will be awarded to the authorized account holder of the email address.

12. Entries must be received before the end of the Giveaway Period and the Sponsor’s database clock shall be the official timekeeper for the Giveaway.

13. Due to the unique nature and scope of the Giveaway, Sponsor reserves the right, in addition to those other rights reserved herein, to modify any date(s) or deadline(s) set forth in these Official Rules or otherwise governing the Giveaway.

14. The following prizes shall be given away as part of the Giveaway: Surprise Pro Box filled with professional goods valued over $100 which will be mailed to the 3 winners after the Event.

15. The prizes cannot be redeemed for cash and shall have no other value.

16. Sponsor reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value of $100 USD if a prize described in these Official Giveaway Rules is unavailable or cannot be awarded, in whole or in part, for any reason.

17. The Approximate Retail Value (“ARV”) of the prize represents the Sponsor’s good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash.

18. Sponsor makes no representation or warranty concerning the appearance, safety or performance of any prize awarded.

19. Restrictions, conditions and limitations may apply.

20. The Sponsor will not replace any lost or stolen prize items.

21. Failure to comply with the Official Rules will result in forfeiture of the prize.

22. Three (3) winners will be randomly selected on April 15th, 2024.

23. Winners will be notified of their winnings via information at the email address provided upon entry.

24. The prize will be sent to the Entrants randomly selected as winners via post to the postal address indicated in the entry submission form.

25. Expenses not specifically included in the prize description, including shipping and handling, and all taxes are the sole responsibility of the Sponsor.

26. No substitution of a Prize is permitted, except the Sponsor reserves the right to substitute a Prize for an item of equal or greater value in the event an advertised prize is unavailable.

27. If for any reason the Giveaway is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond our control that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Giveaway, we reserve the right, in our sole and exclusive discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Giveaway.

28. In addition to our Privacy Policy, Entrants agree that personal data, especially email, name and address, may be processed, shared and otherwise used for purposes within the context of the Giveaway and any other purposes outlined in these Official Giveaway Rules. The data may also be used by us in order to verify an Entrant’s and/or Winner’s identity, postal address and telephone number or to otherwise verify the Entrant’s eligibility to participate in the Giveaway and/or receive a Prize. Entrants have the right to access, review, rectify or cancel any personal data held by us by contacting us via any “contact us” or “message” link on the Pages. Personal data will be used by us and our affiliates exclusively for the purposes stated herein.

29. These Official Giveaway Rules will be governed and construed in accordance with the laws of the State of Illinois without regard to its conflicts of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in the State of Illinois, County of Cook, and any cause of action that arise from or relates to a Giveaway or from interpretation of these Official Giveaway Rules must be filed in the state and federal courts located in the State of Illinois, County of Cook, subject to the arbitration provisions contained herein.
