SMS and Voice Calls

  1. Booksy, we, us or our - Booksy Inc., with its principal place of business at 2045 W Grand Ave Ste B PMB 991343 Chicago, IL 60612-1577.
  2. Message(s) - marketing text messages (such as SMS, MMS) or marketing voice calls, sent or made by or on our behalf, by any means or technology, including without limitation automatic telephone dialing systems, artificial intelligence (“AI”), or other automated means for the selection and dialing of phone numbers to the phone number you provide us.
  3. Opting In - requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive Messages, subject to the requirements of applicable law.
  4. Terms - these SMS and Voice Calls Terms of Service (Booksy Biz App).

2. Opting In: Key Information

  1. Terms apply to all our marketing messaging programs that utilize telephone numbers to deliver Messages to you.
  2. By Opting In to receive Messages you agree to these Terms. Your use of Booksy Biz App , including marketing messaging programs, are subject to the Booksy Biz App Terms of Service and Privacy Policy. Capitalized terms used but not defined herein shall have the definitions provided in the Booksy Biz Terms of Service. In the event of a conflict between the Booksy Biz App Terms of Service or Privacy Policy and these Terms, these Terms shall control solely with respect to marketing messaging programs.
  3. Your consent to receive Marketing Communications from us via Messages is not required to enter into an agreement between you and us for using Booksy’s Services.

3. Eligibility

By Opting In you represent, warrant, and covenant that, for each wireless phone number you provide to us, you are authorized to provide such phone number to us, the phone number subscriber is at least 18 years of age, and the phone number subscriber has consented to receive communications from us, including but not limited to Messages.You agree to indemnify and hold us harmless from and against any and all claims, liabilities, damages (actual and consequential), losses and expenses (including attorneys’ fees) arising from or in any way related to your breach of the foregoing.

4. E-Sign Disclosure

  1. By agreeing to receive Messages, you also consent to the use of an electronic record to document your written consent and confirm you can access records electronically.
  2. You may withdraw your consent to the use of the electronic record or request paper copies at any time by contacting info.us@booksy.com or opting out as described in Section 8. Consent withdrawal will end your participation in Messages, but will not affect the validity of electronic records provided before your withdrawal. To access your electronic records, you will need an internet-connected or SMS-capable device, email address, and ability to retain such records.

5. Privacy

We respect your privacy. For additional information about how we use your personal information, please see the Privacy Policy.

6. Costs of Messages

We don't charge for Messages sent or received through this service. However, standard message, call, and data rates may be applied by your wireless or other applicable provider, depending on your plan.

7. Frequency of Messages

  1. The volume and frequency of Messages will depend on your use of our Booksy Biz App and actions that elicit further Messages from us.
  2. This service may also be used to send you Messages, such as those related to an incomplete registration or 'abandoned cart,' if you do not finish the sign-up process.

8. Opting Out

  1. If you no longer want to receive Messages, you may reply to any text message with STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE or make a verbal opt-out request on any call.
  2. You can also revoke your consent to receive Messages through your “Business Settings” by clicking the settings icon, selecting “Booksy App,” then “Your Data Protection,” and unselecting the checkbox for SMS messaging.
  3. After unsubscribing, we may send you confirmation of your opt-out via text message.

We may modify and update these Terms from time to time in our sole discretion. All changes are effective immediately when we publish updated Terms on our website. Any updates to Terms may be communicated to you, through a notice on the Services or our website, email or text message, and/or by notifying you through other means. You acknowledge your responsibility to review these Terms from time to time and to be aware of any such changes. If you do not agree to any such changes, you can opt-out from receiving Messages as described in Section 8.
