BOOKSY x KIRSTY MEAKIN DREAM COMPETITION

1. Definitions


For purposes of these Official Competition Rules, references to “Sponsor”, “we”, “our”, and “us”, “Booksy” mean Booksy UK Ltd. References to “Entrant”, “you”, and “your” mean a Competition Entrant. References to the “Pages” mean the website or social media page where the Competition is promoted.


2. Agreement to be Bound


The following Official Competition Rules, together with the Terms and Conditions, Privacy Policy, and relevant information set out on the Pages, govern participation in this Competition. By entering the Competition, you confirm that you have read, understood, and agreed to these terms and conditions. Participation in the Competition constitutes a legally binding agreement between the entrant and the Sponsor, subject to applicable laws and regulations. If you do not agree to these terms, you should not enter the Competition.


3. Modifications and Changes to Official Competition Rules


We may modify, add to, suspend, or delete these Official Competition Rules, in whole or in part, at our sole discretion at any time, with such modifications, additions, or deletions being immediately effective upon their posting. Your continued entrance in the Competition after modification, addition, or deletion of the Official Competition Rules shall be deemed to constitute acceptance by you of the modification, addition, or deletion.


4. Eligibility


Entrants must be legal UK residents, at least eighteen (18) years old. Void where prohibited. The Competition is open to licensed nail technicians and/or salon owners. You must be a beauty professional to qualify for the prize. Employees of the Sponsor or affiliates, vendors, and partners, promotional agencies and their advertising agencies, employees of other event hosting services, and members of the immediate families of such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, and any other person residing at the same household, whether or not related. Persons who have won a prize from the Sponsor in the previous three (3) months are not eligible. Winning a prize is contingent upon meeting all eligibility requirements and complying with these terms and conditions.


5. Competition Period


The “Competition Period” shall begin on April 8, 2025, at 12:01 a.m. Eastern Standard Time (hereinafter “EST”) and end on April 25, 2025, at 11:59 p.m. EST. The Sponsor’s database clock shall be the official timekeeper for the Competition.


6. How to Enter


The Competition may be entered by completing the form at the URL. The entry must fulfill all Competition requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Sponsor.


7. Entries


Entries are limited to nail technicians. Entries are limited to one (1) per entrant during the Competition Period. Entries using macro, robotic, script, or other forms of automatic entry will be disqualified. Proof of entry does not constitute proof of receipt. If there is a dispute as to the identity of an online Entrant, the prize will be awarded to the authorized account holder of the email address. The “authorized account holder” is defined as the natural person to whom the email address is assigned by an Internet service provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Entries must be received before the end of the Competition Period, and the Sponsor’s database clock will be the official timekeeper for the Competition. Entries become the exclusive property of the Sponsor and will not be returned or acknowledged. Due to the unique nature and scope of the Competition, Sponsor reserves the right, in addition to those other rights reserved herein, to modify any date(s) or deadline(s) outlined in these Official Competition Rules or otherwise governing the Competition. All Entrants must provide a valid e-mail address upon entry. The Competition Entrant shall be responsible for updating the Sponsor of any change in e-mail address.


8. Prizes


A total of three (3) prize winners of the Competition (“Winner or Winners”) will be selected, with three (3) places: first place, second place, and third place. Each place will receive a different prize, as detailed below:(a) The Winner of the first prize will receive an all-expenses-paid trip to The Nail Mansion, a 5-day luxury retreat held in the United Kingdom, which includes hands-on nail workshops with Kirsty Meakin and other global nail artists, creative challenges, evening events, tarot readings, pool parties, and additional activities as determined by the Sponsor. The Winner will also receive VIP access to Booksy experts to enhance their business operations and accommodation at a private mansion, including a hot tub, pool, and other facilities provided by the Sponsor. The prize is available for the dates of May 11–16th, 2025, and cannot be exchanged, substituted, or redeemed for cash or any other alternative. Any associated costs not explicitly mentioned above, including but not limited to travel, meals, or incidentals, shall be the sole responsibility of the Winner.(b) The Winner of the second prize will receive a Booksy swag bag, containing promotional and branded items, as well as an exclusive discount on Kirsty Meakin products.(c) The Winner of the third prize will receive a Booksy swag bag with an estimated retail value of £200, containing essential products for nail technicians, as determined by the Sponsor. A Prize can not be redeemed for cash and shall have no other value except where required by law.


9. Consumer Disclosure of Odds


Odds of winning depend on the number of entries received. The Winner will be selected from the cumulative collection of entries.


10. Winner Selection


Entries will be reviewed by a panel of judges, including experts from Booksy and Kirsty Meakin, on April 29, 2025. Evaluation will be based on creativity, technique, originality, and overall impact. 


11. Winner Notification; Releases


Winners shall be notified of their win by April 29, 2025, via email at the email address provided upon entry. The Winner must respond via email address, providing his or her contact information for Prize delivery within forty-eight (48) calendar hours from notification, or an alternate Winner shall be selected. Winners may also be required to sign and return an Affidavit of Eligibility, a Liability Release, and, where legally permissible, a Publicity Release within seven (7) calendar days following the date of first attempted notification of winning. Failure to comply with this deadline may result in forfeiture of the prize and selection of an alternate Winner. Return of any Prize and/or Prize notification as undeliverable may result in disqualification and selection of an alternate Winner. Sponsor shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information.


12. Transfer of Prize


The Prize will be delivered via email to the email address provided upon entry. Sponsor shall have no liability for the Winner’s failure to receive the Prize due to spam, junk e-mail, or other security settings or for the Winner’s provision of incorrect or otherwise non-functioning contact information.


13. Prize-Related Expenses; Taxes


Expenses not specifically included in the Prize description, including but not limited to shipping and handling, and all taxes, are the sole responsibility of the Winner. Receipt by the Winner of the prize offered in this Competition is conditioned upon compliance with any applicable UK laws and regulations. Any violation of these Official Competition Rules by the Winner (at Sponsor’s sole discretion) will result in the Winner’s disqualification as Winner of the Competition, and all privileges as Winner will be immediately terminated.


14. Winner’s List


The name of each Winner will be posted to the Pages once the Winner has been selected and verified. Incomplete entries or entries that have been tampered with or fail to meet the requirements set forth herein will be disqualified from being selected as a Winner. To obtain a copy of the Winner’s name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: Booksy UK Ltd, Foundry Eastbourne, 78 The Beacon, Eastbourne, BN21 3NW, United Kingdom. 


15. Intellectual Property Rights; Moral Rights; Grant of License


By entering, Entrant grants to Sponsor a non-exclusive, worldwide, royalty-free, sub-licensable, assignable license to reproduce the entry, his or her name, likeness, and comments and to otherwise use, exploit, copy, modify, adapt, edit, publish and display the name, likeness, and comments in any form, manner, venue, media or technology now known or later developed for any and all purposes, including, without limitation, for purposes of trade, advertising, and promotion as Sponsor and its licensees or assignees determine, without further compensation, notification, or permission.Furthermore, the Entrant grants the Sponsor the right to reuse the entry (including images and text) for Booksy’s social media and marketing purposes following the conclusion of the Competition, including but not limited to Instagram, Facebook, and other platforms, in accordance with the Sponsor’s promotional strategies.The Entrant acknowledges and agrees that they waive any moral rights to their entry, including the right to object to any distortion, mutilation, or other modification of the entry, and the Sponsor shall not be liable for any such usage.


16. No Transfer, Assignment, or Substitution 


No transfer, assignment, or substitution of a Prize permitted, except Sponsor reserves the right to substitute a Prize for an item of equal or greater value in the event an advertised Prize is unavailable.


17. Reservation of Rights


We reserve the right to verify the validity and originality of any entry and/or Entrant (including an Entrant’s identity and address) and to disqualify any Entrant who submits an entry that is not under these Official Competition Rules or who tampers with the entry process. Failure by us to enforce any of our rights at any stage does not constitute a waiver of those rights.


18. Disclaimer of warranties; Limitation of liability; Hold Harmless

(a) By entering this Competition, all Entrants agree to release, discharge, and hold us harmless, as well as Sponsor’s partners, affiliates, subsidiaries, advertising agencies, agents, and their employees, officers, directors, and representatives, from and against any claims, losses, or damages arising out of their participation in any Competition related activities and the acceptance, use, misuse, or possession of any prize awarded hereunder, except where such liability cannot be excluded by law.

(b) We do not assume responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of, or unauthorized access to, Competition entries; or alteration of entries beyond our reasonable control. We are not responsible for technical malfunctions of any page, telephone network, computer systems, servers, providers, software, or any failure of an email entry to be received due to technical problems or internet traffic congestion. This includes any injury or damage to entrants' or other persons' devices related to or resulting from participation, uploading, or downloading materials related to this Competition.

(c) Although all information and materials provided regarding this Competition are believed to be reliable, we make no representations, either express or implied, as to their accuracy, completeness, or timeliness. By entering the Competition, you acknowledge that we expressly disclaim any warranties, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

(d) In no event will we or our subsidiaries, affiliates, employees, agents, third-party content providers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising from the Competition.

(e) We take reasonable measures to protect your personal data in compliance with applicable data protection laws, including the UK GDPR. However, we shall not be liable for any unauthorized access to or use of personal data beyond our reasonable control.

(f) The Sponsor is not responsible for any printing, typographical, or administrative error in the promotion of the Competition. Some jurisdictions do not allow the exclusion or limitation of liability for certain types of loss. In such cases, our liability shall be limited to the extent permitted by law.


19. Indemnification 


You agree to defend, indemnify and hold us harmless, and our affiliates and respective directors, officers, employees and agents, from and against all claims and expenses, including attorneys' fees, arising out of or related to your participation in the Competition run by us and/or any prizes won therethrough.


20. Right to Cancel or Suspend Competition 


If for any reason the Competition is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond our control that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Competition, we reserve the right, in our sole and exclusive discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Competition.


21. Data Privacy


In addition to the general Instagram Privacy Policy, as well as our Privacy Policy, Entrants agree that personal data, especially email, name, and address, may be processed, shared and otherwise used for purposes within the context of the Competition and any other purposes outlined in these Official Competition Rules. The data may also be used by us to verify an Entrant’s and/or Winner’s identity, postal address, and telephone number, or to otherwise verify the Entrant’s eligibility to participate in the Competition and/or receive a Prize. Entrants have the right to access, review, rectify, or cancel any personal data held by us by contacting us via email at marketing.gb@booksy.com. Personal data will be used exclusively by our affiliates and us for the purposes stated herein.


22. Governing Law


These Official Competition Rules will be governed by and construed in accordance with the laws of England and Wales, without regard to its conflicts of law provisions. By entering the Competition, Entrants agree to submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any dispute arising out of or in connection with the Competition or the interpretation of these Official Competition Rules.


23. Arbitration


You agree that any dispute concerning, relating to, or arising from these Official Competition Rules shall be resolved exclusively through binding arbitration, in accordance with the rules of the Chartered Institute of Arbitrators (CIArb) or another recognised arbitration body in the United Kingdom, as selected by the Sponsor. The arbitration proceedings will be conducted in England and Wales and governed by the laws of England and Wales, without reference to their conflicts of law provisions. The arbitrator, and not any court or agency, shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of these Official Competition Rules, including any claim that any part of these rules is void or voidable. Notwithstanding the foregoing, if the dispute involves a claim that is within the monetary limits and is otherwise suitable for resolution in a court without the need for arbitration, the parties agree that such claims may be resolved through the courts in England and Wales, and the dispute will be adjudicated by the relevant court rather than through arbitration.


24. Severability of Provisions


If any provision of these Official Competition Rules shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Official Competition Rules and shall not affect the validity and enforceability of any remaining provisions. Any remaining provisions shall be given effect to the fullest extent possible.


25. Entire Agreement


This constitutes the entire agreement between the parties concerning these Official Competition Rules.
